The commission is not proposing new rules during the current election cycle.
Federal Election Commission (FEC) Chair Sean Cooksey announced the commission will not propose new rules for election ads containing AI this year. Voluntary disclosures from tech companies are all that is to be expected in the current election cycle.
The FEC has maintained that jurisdiction over on-air broadcast political ads is theirs after the Federal Communications Commission (FCC) issued a proposal requiring AI disclosures.
Chair Cooksey said, “A rulemaking to limit or prohibit AI in campaign communications would not only overstep the [FCC’s] limited legal authority to regulate political advertisements, but it would also insert the agency—in the middle of an election—into a developing technology in which it has no expertise or experience.”
He continued, “The better approach is for the FEC to wait for direction from Congress and to study how AI is actually used on the ground before considering any new rules… and [the agency] will continue to enforce its existing regulations against fraudulent misrepresentation of campaign authority regardless of the medium.”
